HIPAA

We provide advice regarding applicability and interpretation of HIPAA, and many of the contracts we draft require HIPAA-compliant business associate provisions, which we prepare.

Business associate agreements often are presented as boilerplate, but in our experience it is common for proposed business associate agreements to include a range of restrictive provisions that are not required by HIPAA.  It is also common, in our experience, for required HIPAA provisions to be ignored or overlooked altogether.
